Zhang Hongbao:Liu Junguo Borrowed a Dagger to Kill His Benefactor
刘是谋杀嫌犯
Liu Junguo Borrowed a Dagger to Kill His Benefactor
by Mo Qian (Zhang Hongbao)
The report from Liu Kaishen’s corpse dissection indicated that there was ten times the normal dosage of the drug “Tranquillizer” in Liu’s blood and liver. “Tranquillizer” is a common drug made and used in China for mental illness. Its foundation is to sedate and it can cause shock and suffocation leading to death due to lack of oxygen if taken in big dosage with the influence of alcohol. Common people can’t buy “Tranquillizer” in America due to its side effect and risks. In mainland of China “Tranquillizer” is a restricted drug and is not available over the country. Even for a doctor there is a limited amount for possession of the drug through personal connections. America never produces “Tranquillizer” nor imports it from China. Taiwan doesn’t use “Tranquillizer” in its medical practice either.

The corpse dissection report also indicated that the fatal reason is not the “Tranquillizer” nor the head trauma but the suffocation from an extended force. Who could kidnap Liu Kaishen for more than four hours, beat him up and force him to take “Tranquillizer” or inject “Tranquillizer” into him before he was killed? We can be sure that the killer was conceiving the plan for a long time and had the whole procedure planned out and prepared. The killing was done in a very cruel and cold-blooded way and had the element of an intelligence crime. But it was not conducted by a professional killer base on the means of killing and the long procedure. Liu Kaishen was found dead at the side of the street near the park. Although the site was quiet and out of the way, since there was no sign of a fight at the site and occasionally there were cars and passengers going by, it was absolutely not the primary crime site. In order to kidnap, beat up, inject the drug and then choke Liu to death, the killer(s) must have chosen a more secluded indoor place. The most ideal site would be an empty independent house with an attached garage or a motel in Berkeley with direct parking in front of the room.

The whole murder procedures have three steps: questioning, threatening and injecting Tranquillizer drug; abandoning the dead body. It took at least two strong people to accomplish the above procedure. Therefore I think this is a case of joint murder including people that Liu Kaishen trusted. Why was the killing a joint work? How was it done jointly? How was this group formed? The means commit the crime by the murderers were determined by their knowledge and social experience. By the use of Tranquillizer in this case, it can be inferred that the murderer and the involved were recent new immigrants from mainland of China.

By the comments and feedbacks from all Liu Kaishen’s colleagues and friends, we can see Liu had a good reputation at his work and was not on bad terms with anybody. There were no signs of bringing upon the disaster of murder upon him. Liu had hardly any opportunity contacting new Chinese immigrants at his world or in his daily life circle. It was even less possible for him to have contact with the lower class immigrants or new immigrants included to committing crimes. However in the circle of democratic movement he would have this kind of contact.

As the Chinese saying goes “A final conclusion is reached when a person is dead”. What merits had Liu Kaishen achieved in his whole life? The memorial article from all kinds of people at his memorial ceremony answered this question. The majority people at his memorial ceremony were from democratic movement circle and the memorial articles focused mostly on how he contributed to the development of democratic movement.

Based on this, I am sure that Liu Kaishen was an important leader in Chinese overseas democratic movement. Within his fifteen years dedicated service, Mr. Liu Kaishen had a high reputation and prestige among the Chinese democratic movement circle and he founded and headed “21st Century Chinese Fund Association” which had stable resources and strong people support. Liu was considered an important figure in the democratic movement world. As the democratic movement resources started to exhaust and the people involved became more complicated, the resources and power Liu Kaishen had became very obvious and would be likely to attract envy, greed and covetousness.

Liu Kaishen helped many democratic movement people and also offended some people. But there were very few people who knew about his personal life. The vice chairman of the Fund Association said, “I didn’t know that Liu Kaishen had a girlfriend until ha passed away.”

Mr. Yang Jianli at his memorial ceremony also said: “Fifty seven year old Liu Kaishen gave lots of help to scholars and democratic movement people when he was alive. His sudden death is a loss to the academic world and to the democratic movement world.” But he was in the democratic movement world, Liu Kaishen was not having an easy time. The way he handle the Democratic Voice radio station and the 21st Century Fund Association brought upon known or unknown envy and resentment from the democratic movement people.

Envy, money and power are the common motive behind murder. From the fact that there was a long four hours time frame between Liu’s leave and his murder and the fact that he was tortured during his capture that Liu’s family was not blackmailed and there was no loss to his personal possessions. We can obviously see that the murderer were not covering Liu’s personal possessions, and definitely not interested in his achievements in environmental protection research but were covering Liu’s political resources in Chinese democratic movement – the 21st Century Fund Association including the sources of donations and the common power etc. The main motive of the murder was money and power. The murderers were in the democratic movement circle and were people who were close Liu Kaishen.

Liu Kaishen participated and supported the Chinese democratic movement for more than ten years and there were too many people he had contact with. Such as Yang Jianli, Xu Bangtai, Wang Deyao, Guo Ping, Liu Junguo, Peng Ming and Ma Wenfu. There were too many people to be analyzed one by one. But To judge who had the real murder motive among all these people, we need not only to analyze who had the ambition and boldness but also who was most likely to benefit from Liu’s death.

Let us talk about Peng Ming first. With the fame, the arrogance, the eager and burning greed for money, Peng Ming wanted to regain his power after he just came to the west side of America. He may be the one who is very likely to do anything for money. Peng Ming needed a sum of money to return to power. How should he get money? He expressed his own unique ideas in his article “Democratic Project” about kidnapping, catching wolves with bare hands (money gaining with no expenses) and killing some rich people etc.It is worth nothing that Peng Ming has this pet phrase: “If you don’t listen, I’ll give you a shot!” If somebody was tempting Peng Ming with the money and position of the 21st Century Fund Association, Peng Ming would definitely step forward the take the risk.

Peng Ming had a good buddy named Ma Wenfu whose real name was Tian XX. Ma Wenfu was originally an army man and had six false names had a rather important background.Ma Wenfu came back and forth between mainland China and the US for four thims. Using his connections in China, Ma would have no problem smuggling a shot of Anding from China into America. Ma also went to Thailand and some other East Asian countries many times for Peng. Ma had the ability of plotting a risky event.

Let’s take a look at Liu Junguo among the Chinese in the Bay Area after he came to San Francisco in 1989. He was one of the few lucky students who exiled of the June 4 movement in Beijing. Besides Liu’s ex-girlfriend Liu Kaishen was Liu Junguo’s second benefactor who not only provided with long time financial support but also recommended Liu Junguo to Berkelay Law School when he couldn’t find any job after getting his MA degree. Because they both had the same last name and there was bestowing and receiving big favors between them, they had an unusual close relationship. No wonder the outsides had rumors that Liu Junguo was Liu Kaishen’s godson.

Liu Junguo was a former member of the 21st Century Chinese Fund Association and seemed to leave the association after Yang Jianli became the chairman. But Liu Junguo was never completely left the association in his mind and his ties to the association. Right before and after Liu Kaishen’s death, Liu Junguo was the legal advisor and finance manager for “Tian An Men generation” organization and he was actually in control of his organization together with Wand Dan and was competing with Liu Kaishen’s Fund Association for resources.

Liu Junguo was out of the few people who were introduced to Ms Zhang and who knew the emotional twists and turns between them. Liu Junguo was one of the few people who gained trust from both Liu Kaishen and Ms Zhang. When Liu Kaishen decided to adjust his relationship with Ms Zhang, he hired liu Junguo as his lawyer to obtain the restriction order. Later Liu and Zhang violated that restriction order, would the lawyer not give any advice? The murder of Liu Kaishen was designed in such a wise way that the police were prevented from cracking the case. The man plotter must know the law very well, know the police investigation procedures, know the complicated circumstances of the Chinese community in the Bay Area, and have the ability to persuade and instigate executors. This person had to be a lawyer, also a Chinese lawyer. Liu Junguo met all these requirements.

Judging from the motives for killing, no one else could beat Liu Junguo. Liu Junguo considered himself as the student leader of June 4 Movement, PH.D, lawyer, Main leader of “Tian An Men Generation”, long time member of the 21st Century Fund Association, Bay Area overseas Chinese leader by the false name of Liu Jun, leader of some Agency of the Taiwan Nationality and etc. All these titles made Liu think that he possessed rich political capital and could compare with Wang Dan and Yang Jianli who leave for more influential democratic movement leaders. When Liu Junguo got his citizenship, he changed his name to Arthur Liu with the ambition of comparing himself to famous European Middle Ages King of Arthur. When he got married to old lady Yan last year, he even enounced himself with kingliness over the internet. His ambition was easily seen as big as the ocean.

To achieve his ambition, Liu Junguo would rather “betray others but be betrayed by others”. To achieve his ambition quickly, he didn’t want to do labor work like other overseas Chinese students. Instead, he cheated by love, he snatched other’s wife and he wrecked others’ family. After he completed his academy study, he abandoned his lover who supported him for more than ten years and made false countercharges against her.

Liu Junguo thought that he had the language communication and management ability for entering the political world once he finished his English literature and MBA studies. His next step was to study law so that he could in the future win the world and also make disturbances to make profits. For this purpose he had to curry favor with Liu Kaishen and to get his recommend. Liu Junguo looked down upon the older generation democratic movement people and considered the Tian An Men generation no match for him. The only peer competitor was PH.D.Yang Jianli who was always above him. Yang Jianli was a graduate from Kennedy Political Institute of Harvard University and was standing out on the international political stage as soon as he graduated. Liu Junguo devoted himself wholeheartedly to becoming a power figure and now encountered Yang Jianli who was a politics major. “How could two power figures co-exist?”

Liu Junguo served Liu Kaishen like a son and aimed at the 21st Century Fund Association to service for its power and resource. Liu Kaishen had known Liu Junguo for many years and he compared Yang Jianli and Liu Junguo to good and evil. Later Liu Kaishen chose Yang Jianli to be in change of 21st Century Fund Association and the Spokesperson. Ambitious Liu Junguo lost again and became very jealous and malicious. Once again he raised his dagger at his second benefactor.

Liu Junguo is a lawyer and was already well-off. But his greed for money is beyond imagination. For money he could sacrifice his youth, love, fame, friendship and all and risk his life. Right now that is known to people is how he seduced old lady Qingxin Yan to steal over 1.5 million dollars from Chinese democratic movement fund. In fact, before this he already embezzled 14,000 dollars fund from Tian An Men Generation organization and made the organization fell apart. Now Liu Junguo owned several million dollars but he would not pay back that 14,000 dollars. He was so greedy that he would not care for anything else.

Since Liu Junguo got his lawyer license, he got involved in the Fund Association’s affairs as a legal advisor, controlled the fund and provoked internal confusion in the organization to gain personal benefits. Same behavior was seen in other democratic movement groups he was involved in other than 21st Century Fund Association such as Tian An Men Generation and Chinese Federal Development Fundation.

The death of Liu Kaishen gave Liu Junguo an opportunity to take over the real power of 21st Century Fund Association as well as to end his envy and resentment, which was obvious from his behavior at Liu Kaishen’s memorial service. Based on his close relationship to Liu Kaishen, he should be very grieved and gave a speech. Instead wearing sunglasses he was accompanied by two female secretaries and was very low-key in that social event. Was he trying to conceal his disharmony feelings by wearing sunglasses in winter?

The motive of murder is only a thought and it depends on the ability of plotting and carrying it out to become a crime. At that time Liu Junguo has been a lawyer in practice and is very familiar with criminal law. If Liu Junguo planed to harm Liu Kaishe, he must be successful because Liu Kaishen trusted him and would not guard against him. Liu Junguo lived in San Francisco for more than ten years and was familiar with the social environment in the Bay Area. He was aware that the dark society there ran rampant and there were low rate criminal cases cracked by the police. He could easily use this fact to encourage himself and his members. Liu Junguo and Peng Ming were then in close contact and built a solid trust in between. Peng Ming considered Liu Junguo as his personal lawyer and Liu did a lot of law related or non-related things for Peng.

Once Peng Ming and Ma Wenfu became the executors, this plot became an actual plan. Peng Ming then had little knowledge about American society and laws, so he completely trusted in and depended on his lawyer. Liu Junguo easily recognized Peng as somebody who was reckless, hasty for success and unscrupulous. Liu could easily bring Peng disaster to Liu Kaishen with little manipulation. Once he had this trust from Peng, Liu Junguo on purpose showed Peng some inside story of the Fund Association and tempted him with money and power. Peng would surely take the risk and t

Liu Kaishen was the key figure in the fund association and he was a scholar. His kindness was the easy target for those reckless people from the mainland of China. Once Liu Junguo enticed Peng to take one step, his whole scheme was ensured to succeed. Peng and his members thought that they could easily made Liu to give up his Fund Association resources with violation and threaten. But they underestimated the bravery of Liu Kaishen. Liu Kaishen who was devoted to the democracy and freedom for the Chinese was not likely to surrender to the evil force. Peng Ming etc could not succeed getting what they wanted and they could not release Liu Kaishen to show they were guilty. They chose to take the risk killing Liu Kaishen and abandoned his dead body and fled.

To hold the readers to understand my analysis better, I’d like to include an upsetting example in the democratic movements. Xu Bangtai, a former president in democratic federation alliances embezzled public funds for ten years with nobody’s knowledge. When Xu Bangtai won the chairman position in the Democratic Federation Alliances and owned the “China Spring” magazine, he started to accept the long terms secret donations from Taiwan. For ten years he almost embezzled all the donations. After all his appetites and needs satisfied, he was even thinking of going back to Shanghai to be a member of the Political Consulate Committee. If it has been not due to his greed, nobody would find this out for another 10 years.

For the past twenty years, in the Chinese Democratic Movement world, due to lack of effective administration system and the constant change of sources of donations, whoever became the head of the resources was then to control the group and to use public funds for personal benefits. Those speculators for profits and those who lost their basic conscience would gather around this kind of head. Liu Junguo already had “good” experience with this in Tian An Men Generation organization and the Xu Bangtai scandal must have given him quite some inspire. There are a lot more other factors that are not listed here.

From above, we can logically come to this conclusion that Liu Junguo is the chief instigator in Liu Kaishen murder case.

Liu Junguo and his witness might deny this by saying that Liu was appearing in court that day or was in office or was with a client or on a business trip etc. We would not think that Liu Junguo would be so stupid and excited that he would appear at the primary crime scene to slap his benefactor. However, he must be directing in distance. If we could have his cellular phone calls record on Jan 9, 2002, we are surely to have a sound conclusion.

Clever Liu Junguo designed this chain event of borrowing a dagger to kill his benefactor without acting in his own name, without spending any money and without leaving his killing motives. After Peng Ming failed in organizing his organization in the east coast of America, he wanted to come to San Francisco to restart. Before this, Peng Ming was introduced by Wang Deyao to Liu Kaishen in Boston. Peng gained Liu’s trust by his sweet talk and the connection with the introducer.

Liu Kaishen’s girlfriend Ms Zhang already had trust in Liu Junguo. Of course, Liu Kaishen would agree to the appointment if Mr. Zhang asked him out. This way the main instigator and the accomplices could work together.

Since Liu Kaishen had to be back to his office for a meeting at 1:30 pm, the place he was asked to meet should be within 10-15 minutes drive away from his office at Berkeley Way. The primary crime scene should not be far from the secondary crime scene either. If on foot Liu Kaishen at 57 years old, wouldn’t walk more then 10 blocks. Liu’s friends in Bay area knew Liu was a careful person. He would not get in other people’s cars other than Liu Junguo’s or Ms Zhang’s. Around 1 pm of the same day of the murder, Ms Zhang left a message at his office right after Liu Kaishen left the office saying:“Hi, I am here!” Did that mean she arrived at the empty room or downstairs to meet Liu Kaishen? Only she knows. She refused to talk about this. Ms Zhang might be used by the murderers for her business. Up till now she still refuses to say anything. She must have been scared and threatened.

In January 2002, Peng Ming and Ma Wenfu were still living in the east coast of America. At the beginning of that January, Peng disconnected his residential phone and cellular phone and had his visa and plane tickets ready for Thailand with Ma Wenfu. At that time Peng Ming’s cellular phone was paid by Yang Haiping who is a leader of Chinese community in Bay Area. It was bizarre that cheap Peng Ming suddenly would cancel his cellular phone service. After the murder of Liu Kaishen happened, Peng and Ma flied to Thailand and didn’t come back to San Francisco “safely” until the end of February when the police ended the case as a death of heart attack.

In April 2002, Yang Jianli was betrayed when he went back to mainland of China. The donors stopped to give more money to the Fund Association and the organization fell apart. There was rumor on the internet that Yang Jianli was betrayed by Wang Xizhe because Yang Jianli was a standing committee member of the Nationalist started to get close to the Democratic Party in power. What I believe is that Liu Junguo was actually the one who betrayed Yang Jianli not Wang Xizhe. Liu Junguo was then one of the leaders in the Nationalist in San Francisco. In order to snatch the resources of the 21st Century Fund Association, he first borrowed Peng Ming’s hand to get rid of his benefactor, then borrowed the Communist Party’s hand to remove his strong political career competitor Yang Jianli by using the power struggle between the two parties to accomplish his own scheme. Liu Junguo had this scheming ability and had the evil intention. However his plan couldn’t beat God’s plan. He couldn’t get 21st Century Fund Association as he expected.

Peng and Liu had to start all over again by establishing Chinese Federal Development Foundation and were looking for other means to get money. Peng Ming and Liu Junguo each had his strong points in their great for money and their unscrupulous means in getting money. The Chinese Federal Development Foundation didn’t come to a good end either. But I have been bothered by this question is my mind. How could Liu Junguo who was stingy about money submit to Peng over money for several times? First time was180,000 dollars, second time was 140,000 dollars plus 20,000 or 30,000 dollars to Ma Wenfu.

Now I have the answer. Because there was a secret among them, Liu didn’t want to perish together. Liu Junguo recently suddenly closed his law office and left California. Common people could not help asking, what made him come to such a difficult decision? Liu started from a new immigrant to an American lawyer and reached his American dream in San Francisco. All his social connections, friends, clients, office and home etc were in San Francisco. How was he willing to leave all these behind? The best answer to this kind of question is: In San Francisco, he always lives in guilt and the fear of the truth coming to light.
